Terms of Service

These Terms of Service ("Terms") cover your use of 88thstreetrecords.com (the "Site") and the products we offer there, including audio plugins and music releases (the "Products").
88th Street is a trading name of 88th Street LLC, registered at 119 W 88th Street, New York, NY 10024 ("88th Street," "we," "us," or "our"). When you use the Site or buy a Product, you are contracting with 88th Street LLC, and you agree to these Terms.
1. Orders and payment
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle handles checkout, payment, billing, sales tax, and refunds under the Paddle Buyer Terms and our Refund Policy.
2. Plugin licenses
Our plugins are licensed to you, not sold. Each plugin comes with an End User License Agreement ("EULA") shown during installation, and the EULA governs how you install and use the plugin. If these Terms and the EULA conflict about plugin use, the EULA controls.
Full versions are licensed through iLok, a licensing system run by PACE Anti-Piracy, and require a free iLok account. Lite versions are free to download and use without activation.
3. Using the Site and Products
You agree to use the Site and Products lawfully and to keep the licensing intact. You may not share, resell, or redistribute plugins or licenses, crack or bypass licensing, or reverse engineer our software, except where the law allows it.
4. Music and content
Our records, artwork, videos, text, and logos belong to 88th Street or our artists. You may stream and enjoy them for personal use. Any other use needs our written permission.
5. Availability
We work to keep the Site, downloads, and Products running. We cannot guarantee uninterrupted or error-free service.
6. Disclaimer
To the fullest extent the law allows, the Site and Products are provided "as is" and "as available." Any warranties in the EULA still apply, along with any rights you have under consumer law.
7. Limitation of liability
To the fullest extent the law allows, our total liability for any claim related to the Site or Products is limited to the amount you paid for the Product involved in the 12 months before the claim. We are not liable for indirect or consequential losses, such as lost data or lost profits. Nothing in these Terms limits liability that the law does not allow us to limit.
8. Changes and termination
We may update these Terms, and the date at the top shows the latest version. If you break these Terms or the EULA, we may suspend your access to downloads or licenses.
9. Governing law
These Terms are governed by the laws of the State of New York, United States, unless your local consumer law gives you other rights.
